  2. ‘You’, ‘Your’ or ‘Buyer’ refers to to the consumer making a purchase from us.
  3. ‘Website’, ‘Site’, ‘Store’ or ‘Shop’ refers to this website  (store@partsforclassic.com).
  4. ‘Goods’ or ‘Products’ refers to the items on sale on this website.
  5. ‘Conditions’ refers to this set of terms and conditions.
  6. ‘Order’ refers to Goods you pledge to buy after completing the checkout process.

 

 

2. Formation Of Contract

 
 
  1. When you order from us you are entering a contact and accepting these terms & conditions. You should check the contents of your order and correct any errors. Once your order has been dispatched any mistakes cannot be rectified and we will not be responsible for. Once you have completed the checkout proccedure you will be given a unique order number which you must make note of and supply to us during any corrospondance.
  2. All goods are subject to availablility.
  3. We can refuse or cancel your order for any of the following reasons: Goods become unavailable, payment is not autorised, if you do not meet the criteria set out in these conditions or if we believe there are reasonable grounds for refusing an order.

 

 

3. Price & Delivery

 
 
  1. Prices advertised on this site are in Euros and are inclusive of all  taxes and VAT (where applicable).
  2. We do no ship worldwide.
  3. You will be notified when your order has been dispatched
  4. Delivery times are issued in good faith and in no way are legally binding. We will not be responsible for any inconvenience caused through delay or loss.
  5. Delivery charges are set out on the Delivery InformationPage of this site. Delivery charges are also quoted during the checkout process. Charges are based on location and weight. Once an order has been placed we are not responsible for any changes to the address.
  6. A signature may be required once goods are delivered to you. Once signed for they become your property and we will not be liable for any loss or damage to goods once they have been delivered to you. When you receive your goods please check contents and inform us within 24 hours of any missing items. After this time period no liability will be assumed by us.
  7. If after 4 weeks of confirmation of your order you haven’t received your goods, you must notify us immediately.
  8. Goods must be used for the purpose for which they are intended. We will not be responsible for any injury or damage caused by the misuse of Goods.
  9. If Goods are damaged or faulty You must inform Us within 3 working days. Damage or faults after this time will be deemed as Your responsibility. Electrical items will be guaranteed under a manufacturers warranty.
  10. We reserve the right to change and amend prices at any time without any warning. Please check the amount during the checkout process before confirming and placing your order.
  11. Prices displayed on the website exclude delivery charges.

 

 

4. Delivery of the goods

 
 

1. When ordering the goods, the Buyer undertakes to specify the place of delivery of the goods, as well as his contact information.

2. The Buyer undertakes to accept delivery of the goods himself. In the event that the Buyer is unable to take delivery of the goods himself and the goods are delivered to the address indicated and on the basis of the other data provided by the Buyer, the Buyer shall not be entitled to make any claim against the Seller in respect of the delivery of the goods to the wrong entity.

3. The delivery of the goods shall be subject to payment. The goods shall be delivered by courier services:

3.1 The price of delivery depends on the weight of the Goods and is provided separately at the time of each order.

4. The Seller undertakes to send the goods to the Buyer within 7 working days. This time limit does not apply in cases where the Seller’s warehouse does not have the goods required and the Buyer is informed of a shortage of the goods ordered. The Buyer also agrees that in exceptional circumstances the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such a case, the Seller undertakes to contact the Buyer immediately to agree on the delivery of the goods.

5. In all cases, the Seller shall be exempt from liability for breach of delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Buyer’s control.

6. At the time of delivery of the goods, the Buyer shall inspect the condition of the consignment with the Seller or its authorised representative. Once the Buyer has signed the invoice (bill of lading) or any other document of delivery and acceptance of the consignment, the consignment shall be deemed to have been delivered in good condition. If the Buyer notices that the packaging of the delivered consignment is damaged (crumpled, wet or otherwise externally damaged), the Buyer must note this on the invoice (waybill) or other document of delivery and, in the presence of the Seller or his representative, draw up a free-form consignment damage report. If the Buyer fails to do so, the Seller shall be exempt from liability to the Buyer in respect of any damage to the goods, provided that such damage is caused by damage to the packaging not marked by the Buyer in accordance with the procedure set out above.

7. In the event that the Buyer notices, upon acceptance of the goods, that the consignment does not contain the correct set of goods or that the delivered goods are not of the correct size, colour or other dimensions, the Buyer shall immediately inform the Seller thereof.

8. In the event that the Buyer withdraws from the contract of sale pursuant to Clause 5.2 of the Regulations, the Buyer shall be liable to pay all direct costs of returning the goods to the Seller in accordance with the transport rates set out in the table above. The amount of these costs incurred by the Seller shall be deducted from the monies paid by the Buyer for the item(s) to be returned. If the set-off does not cover the Seller’s claim in full, i.e. if the Seller’s costs of returning the goods exceed the value of the item(s) to be returned, the Buyer undertakes to pay the Seller the remaining amount within 15 days.

 

 

5. Cancellation & Returns

 
 
  1. If you wish to cancel your order before dispatch you may do for any reason, however you must contact us as soon as possible by using our  Contact Form quoting your order number. If car parts have already been dispatched you must return them within 14 working days and return postage costs will not be met by us.
  2. If you wish to return goods you may do so for any reason but you must contact us within 14 working days of placing your order before sending them back using the   Contact Form
  3. You are free to return goods for a refund if they are unused and in their sealed state and are suitable for re-sale. You will be refunded for the price of the goods only. Shipping costs, paypal fees, return postage costs will be met by You. Refunds will only be authorised once these conditions have been met and we have received the goods. You are advised to obtain proof of posting and insurance when returning goods as they will be your responsibility until they are received by us.
  4. Where promotional discounts or free delivery are used based on a certain spend and a return is made which is not faulty we reserve the right to deduct the amount due for postage from the refund due to you.
  5. Your Statutory Rights are not affected.

 

 

6. Buyer’s rights

 
 

5.1 The Buyer shall have the right to purchase goods in the E-Shop in accordance with these Terms and Conditions.

5.2 The Buyer shall have the right to withdraw from the contract for the purchase and sale of goods concluded with the E-shop by notifying the Seller in writing (by letter, fax or e-mail) no later than within 14 (fourteen) working days from the date of delivery of the item.

5.3 The Buyer may exercise the right provided for in Clause 5.2 of the Terms and Conditions only if the goods have not been damaged or substantially altered in appearance, nor have been used.

5.4 The Buyer may exercise the right provided for in Clause 5.2 only if the goods have not been damaged or the appearance of the goods has not been materially altered, nor have they been used.

 

 

7. Obligations of the Buyer

 
 

7.1 The Buyer shall pay for and accept the Goods in accordance with these Conditions.

7.2 The Buyer undertakes not to disclose its login details to third parties. If the Buyer loses his/her login details, he/she must immediately inform the Seller using the means of contact indicated in the “Contact” section.

7.3 If the data provided by the Buyer in the registration form changes, the Buyer must update them immediately.

7.4 By using the E-shop, the Buyer undertakes to comply with these Terms and Conditions, the other terms and conditions expressly stated in the E-shop, and not to violate European Union legislation.

 

8. Seller’s rights

 
 

8.1 If the Buyer attempts to undermine the stability and security of the Online Shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer’s access to the Online Shop or, in exceptional cases, to cancel the Buyer’s registration, immediately and without warning.

8.2 In the event of serious circumstances, the Seller may temporarily or permanently suspend the operation of the Online Shop without prior notice to the Buyer.

8.3 The Seller shall have the right to cancel the Buyer’s order without prior notice to the Buyer if the Buyer fails to pay for the goods.

 

 

9. Obligations of the Seller

 

9.1 The Seller undertakes to enable the Buyer to use the services provided by the E-shop on the terms and conditions set out in these Terms and Conditions and in the Online Shop.

9.2 The Seller undertakes to respect the Buyer’s right to privacy with regard to the personal information belonging to him, as indicated in the registration form of the Online Shop, except in the cases provided for by European Union legislation.

9.3 The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by the Buyer.

9.4 If the Seller is unable to deliver the goods ordered to the Buyer due to important circumstances, the Seller refund the money paid by the Buyer within 2 (two) working days, provided that prepayment has been made.
